What's the charge on these 3 scenarios?
These possible scenarios are based on Florida law. I have answered some but I need to know if they are correct or not. Best help gets 10 points!
(1.) What is required to return an insufficient fund check into a worthless check?
-I think it's Prima facie evidence of Intent.
(2.) What may a store clerk demand from a customer for an I.D. before cashing a check?
-I chose Driver's License # or state I.D. #
-Presenter's full name, address, home phone #, business phone, POE, sex, DOB.
(3.) Stanley is drunk on Spring Break. He hits a horse and caused it to break its leg. Horse needs to be put down (killed). What's the charge or punishment?
-This was tricky. Statute has great bodily harm = felony 3rd degree..(causes horse to be put down, but did not kill the horse while crime was committed), OR bodily harm = misdemeanor 1st degree...(harmed the horse, horse broke its own leg?), and/or pay restitution for replacement horse.
Not familiar with FL law but in no state can #3 have the same charges as those placed for hitting a human.
In my state the charge is damage to property and/or cruelty to animals and the courts order responsible payment for the horse.
The victim (owner not the horse who cannot be a victim since he is chattel property) can sue for more, such as lost wages or other use/benefit derived from the horse.
On #1 don't you mean a worthless document? All ISF checks are worthless documents. You only need intent for a criminal charge.
One summer had a drunken young lawyer refuse orders to leave the park at closing. He ran toward me to hit me, I side stepped and he ran into a mounted unit horse, hitting it. The horse did not notice.
When I got him into the station he started to sober up as he saw his career go down the tubes. To teach him and even worse lesson I charged him with the lesser crime (punishment wise) of cruelty to animals. He knew if that got out he would not be able to get any job, let alone stay at a good firm.
Spent 5 grand on lawyers to get him out. All the judge told his was to apologize to me and to stop drinking in the park
